Introduction
This is a draft for review, not legal advice. Welcome to Try Before You Dye ("the Service"), operated by PRO DIGIT STUDIO LLC ("we," "us," or "our"), a limited liability company formed in the State of Wyoming, USA. These Terms of Service ("Terms") govern your access to and use of the website at trybeforeyoudye.ink and all related features, including our tattoo design gallery, AI try-on, Tattoo Read, Designer, Lettering, and care content. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. The Service is intended for users in the United States. You must be at least 18 years old to create an account or use the Service. By using the Service you confirm that you are 18 or older.
Your Account
To use most features, you need an account. You can register with an email address and password or sign in with Google. We use Supabase to manage authentication and store your account information. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Please notify us promptly if you believe your account has been accessed without your permission. You agree to provide accurate information when you register and to keep it up to date. We may suspend or close accounts that violate these Terms, that are used for fraud or abuse, or where required by law. You may close your account at any time. Closing your account does not entitle you to a refund of purchased credits except where required by law (see the Credits and Payments sections below).
Credits
Many features of the Service run on credits. Credits are a digital good used inside the Service and have no cash value outside it. When you first register, we grant you a one-time allotment of 5 welcome credits. Welcome credits are provided as-is, may expire or change, and are not redeemable for cash. Features consume credits as follows: a try-on generation costs 2 credits; a Tattoo Read analysis costs 1 credit; a Designer image generation costs 2 credits. The Lettering feature is free and does not consume credits. We may adjust credit costs for features over time; any change applies to future use, not to credits you have already spent. Credits you have already spent are consumed and are not refundable or reversible, except where required by law. Your credit balance and a history of your credit transactions (purchases, spending, welcome grants, and any refunds) are available in your profile. We may grant, adjust, or reverse credits in cases of billing errors, fraud, or technical issues.
Payments
You can buy credit packages through our checkout, which is processed by Stripe. Prices are shown in US dollars (USD) at checkout. By completing a purchase you authorize the applicable charge. We do not store or process your full payment card numbers. Card details are handled by Stripe under its own terms and security standards. Your use of Stripe at checkout is subject to Stripe's terms and privacy policy. All sales of credits are final. We do not offer refunds for purchased credits, including unused credits, except where a refund is required by applicable law. Spent credits are never refundable except where required by law. If you believe you were charged in error, contact us at prodigitstudio@gmail.com and we will review the issue. We may use Stripe to issue any refund that we determine is owed or that is required by law.
Acceptable Use
You agree to use the Service lawfully and respectfully. When you upload a photo or other content, you confirm that you have the right to use it and that it does not infringe anyone else's rights. You agree not to: upload content you do not have the rights to use; upload illegal, harmful, hateful, or sexually exploitative material, or images of other people without their consent; use the Service to create content depicting minors in any inappropriate way; attempt to bypass, manipulate, or defraud the credit and payment system; reverse engineer, scrape, overload, or disrupt the Service; or misuse the AI features to generate unlawful, deceptive, or abusive content. We may remove content, limit features, or suspend accounts that violate these rules. Intellectual property and your content: you keep ownership of the photos and content you upload. You grant us a limited license to process your content solely to provide the features you use (for example, sending an image to our AI providers to produce a try-on result). We and our licensors own the Service itself, including its software, design, gallery content we provide, and branding. DMCA / copyright complaints: we respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to our designated agent at prodigitstudio@gmail.com with: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the material you claim is infringing and where it appears; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on their behalf; and (6) your physical or electronic signature. We will respond to valid notices, including by removing infringing material, and we will terminate repeat infringers where appropriate.
AI Content and Results
Several features use artificial intelligence: the Designer chat and image generation, the Tattoo Read analysis, and the try-on preview. These features rely on third-party AI providers, including Anthropic and fal.ai. AI output is provided for inspiration and entertainment only. It is not medical, legal, or professional tattooing advice, and it is not a substitute for consulting a licensed tattoo artist or other professional. A Tattoo Read interpretation of style, symbols, or meaning is an automated guess, not an authoritative statement. Try-on previews show an approximate, simulated result. They do not guarantee how a tattoo will actually look on your skin, how it will heal, or how an artist will execute it. Real results depend on your skin, the artist, and many factors outside our control. AI output can be inaccurate, unexpected, or unsuitable. You are responsible for how you use any output, and you should use your own judgment and consult professionals before making decisions about a real tattoo.
Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will meet your expectations. To the fullest extent permitted by law, PRO DIGIT STUDIO LLC and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service or any AI output. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim or fifty US dollars (USD 50). Governing law and disputes: these Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Arbitration and class-action waiver: except for small-claims matters and requests for injunctive relief, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration rather than in court, and you and we waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing prodigitstudio@gmail.com within 30 days of first accepting these Terms; opting out does not affect the other parts of these Terms. Nothing here limits any rights you cannot waive under applicable law.
Changes to These Terms
We may update these Terms from time to time, for example to reflect new features, legal requirements, or changes to credits and pricing. When we make material changes, we will update the "last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree with a change, please stop using the Service and you may close your account.
